Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Double H Ventures Pty Ltd (as trustee for Hamilton-Hakim Family Trust) trading as Double H Marketing (ABN 38 137 697 042) ("Company", "we", "us", or "our"), an Australian company, governing your access to and use of PDF Export for Asana ("Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

To use the Service, you must:

• Be at least 18 years of age, or the age of legal majority in your jurisdiction
• Have a valid Asana account in good standing
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• If using on behalf of an organisation, have authority to bind that organisation to these Terms

By using the Service, you represent and warrant that you meet all eligibility requirements.

3. Description of Service

PDF Export for Asana is a software-as-a-service (SaaS) application that enables users to generate PDF documents from their Asana projects, tasks, and time entries.

3.1 Service Features

• PDF Generation: Create task lists, time reports, project summaries, and timeline exports
• Template Customisation: Apply custom branding, colours, and layouts to exports
• Export Storage: Store and share generated PDFs via secure links
• Multiple Export Types: Task List, Time Report, Project Summary, and Timeline formats

3.2 How It Works

• You authorise the Service to access your Asana account via OAuth 2.0
• When you request an export, we fetch the relevant data from Asana in real-time
• We generate a PDF document and store it temporarily based on your subscription tier
• The source Asana data is not stored--only the generated PDF

4. Account Registration and Security

4.1 Account Creation

To use the Service, you must connect your Asana account via OAuth authentication. By doing so, you:

• Grant us temporary access to your Asana data for PDF generation purposes
• Agree to provide accurate and complete information
• Accept responsibility for all activities under your account

4.2 Account Security

You are responsible for:

• Maintaining the security of your Asana credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use
• Ensuring your export links are shared only with intended recipients

5. Subscription Plans and Payment

5.1 Available Plans

5.2 Billing

• Paid subscriptions are billed monthly in advance
• All prices are in Australian Dollars (AUD) unless otherwise stated
• Prices include GST for Australian customers
• Payment is processed securely through Stripe

5.3 Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period unless cancelled. You authorise us to charge your payment method on file for each renewal period.

5.4 Cancellation

• You may cancel your subscription at any time through your account settings or by contacting support
• Cancellation takes effect at the end of the current billing period
• You retain access to paid features until the end of your paid period
• Upon expiration, your account reverts to the Free plan

5.5 Refunds

Consistent with the Australian Consumer Law:

• You may request a refund within 14 days of initial subscription if the Service does not meet your reasonable expectations
• Refunds are provided at our discretion for mid-cycle cancellations
• No refunds for partial months or unused features
• Consumer guarantees under Australian Consumer Law are not affected by this policy

5.6 Price Changes

We may change our prices with 30 days' notice. Price changes take effect at your next billing cycle after the notice period.

6. Acceptable Use Policy

6.1 Permitted Use

You may use the Service for lawful purposes to generate PDF exports from your authorised Asana workspaces.

6.2 Prohibited Conduct

You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Access or export data from Asana workspaces you are not authorised to access
• Share, distribute, or sell access to your account
• Circumvent, disable, or interfere with security features of the Service
• Attempt to bypass usage limits or manipulate billing
• Use automated scripts, bots, or scrapers to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the Service or servers
• Use the Service for competitive analysis or to build a competing product
• Export or share confidential information without proper authorisation
• Impersonate any person or entity

6.3 Rate Limits

The Service includes rate limits to ensure fair use and system stability. Excessive use that negatively impacts other users may result in temporary or permanent restrictions.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its software, design, features, documentation, logos, and trademarks, is owned by Double H Ventures Pty Ltd (as trustee for Hamilton-Hakim Family Trust) trading as Double H Marketing and protected by Australian and international intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

7.2 Your Content

You retain all rights to your content, including:

• Your Asana data (tasks, projects, time entries)
• Custom templates and branding you create
• Logo images you upload
• Generated PDF exports

7.3 Licence to Us

By using the Service, you grant us a limited, worldwide, non-exclusive licence to:

• Access your Asana data solely to generate PDFs at your request
• Store and serve your generated PDFs
• Display your logo and branding within your exports
• Use anonymised, aggregated data to improve our Service

7.4 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without restriction or compensation to you.

8. Third-Party Services

8.1 Asana Integration

The Service integrates with Asana. Your use of Asana is governed by Asana's own terms of service and privacy policy. We are not responsible for Asana's service availability, data accuracy, or any changes Asana makes to their platform.

8.2 Payment Processing

Payments are processed by Stripe. By making a payment, you agree to Stripe's terms of service. We do not store your complete credit card information.

8.3 Third-Party Links

The Service may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of external sites.

9. Disclaimer of Warranties

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

10. Limitation of Liability

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).

Australian Consumer Law: If you are a consumer under the Australian Consumer Law, our liability is limited, at our option, to re-supplying the services or paying the cost of having the services re-supplied.

11. Indemnification

You agree to indemnify, defend, and hold harmless Double H Ventures Pty Ltd (as trustee for Hamilton-Hakim Family Trust) trading as Double H Marketing, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you export or share through the Service
• Your negligent or wrongful conduct

12. Service Availability and Modifications

12.1 Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide reasonable notice)
• Emergency maintenance or security updates
• Third-party service outages (including Asana)
• Events beyond our reasonable control

12.2 Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes that negatively affect your use.

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Contacting support to request account deletion
• Revoking Asana access in your Asana account settings

13.2 Termination by Us

We may suspend or terminate your access immediately if:

• You violate these Terms
• Your payment fails and is not resolved within 7 days
• We reasonably believe your use is harmful to the Service or other users
• Required by law or to prevent fraud

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Your PDFs will be deleted according to the retention schedule, and any remaining data will be deleted within 30 days unless required by law to retain it longer.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to contact us at team@doublehmarketing.com.au and attempt to resolve the dispute informally for at least 30 days.

14.2 Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

14.3 Class Action Waiver

To the extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration against us.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to any successor in interest.

15.5 Force Majeure

We are not liable for any failure or delay due to circumstances beyond our reasonable control, including natural disasters, acts of government, pandemic, war, terrorism, or internet or telecommunications failures.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page with a new effective date
• Sending an email notification at least 30 days before changes take effect
• Displaying a notice within the Service

Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
